Terms & Conditions – CallGuard

These Terms & Conditions govern the use of CallGuard, a service powered by The Potter Group LLC.
By using CallGuard, you agree to the following terms.
1. Service Description
CallGuard provides automated missed call text-back services for contractors.
We do not provide AI answering services. We do not guarantee job bookings.
2. User Responsibilities
When calling a business that uses CallGuard, callers may be given the option through an automated phone prompt to opt in to receive SMS messages related to their phone call and/or service request. Callers must provide explicit opt-in consent via this verbal confirmation method by pressing a keypad option during the call before any text message is sent.
You agree to:

You are fully responsible for the messages sent through your account.
3. Payments

Failure to pay may result in suspension. Message & data rates may apply.
4. No Guarantees
CallGuard does not guarantee:

Increased revenue

Specific number of jobs

Service uptime without interruption
5. Limitation of Liability
CallGuard is not liable for:

Lost revenue

Missed jobs
-
SMS carrier filtering
-
Customer disputes
6. Termination
We reserve the right to suspend accounts for abuse, spam, or illegal activity. By signing up, you agree to our Terms & Privacy Policy.
7. Refund Policy
All subscriptions are billed monthly. Refunds are not guaranteed.
8. Governing Law
This agreement is governed by the laws of the United States.
9. Cancellation Policy
CallGuard subscriptions are billed month-to-month with no long-term contracts. You may cancel your subscription at any time by emailing [email protected] with the word “Cancel” in the subject line from the email associated with your account. Cancellation requests must be submitted at least 24 hours prior to your next billing date to avoid the upcoming charge. Upon cancellation, your service will remain active until the end of your current billing cycle. No partial refunds will be issued for unused time.
10. SMS Messaging Program Terms
By contacting a business that uses CallGuard, you consent to receive SMS messages related to your service inquiry. Message and data rates may apply. Reply STOP to opt out.
Consent: Consumers opt in via verbal confirmation only. SMS messages will only be sent to consumers who have opted in via keypad option given to them via voice message played after a phone call is made to a participating business.
IVR Script example:
“Thank you for calling ABC Plumbing. If you would like to receive a text message so we can respond quickly to your request, press 1 to receive a text message regarding your service request. By pressing 1 you consent to receive SMS messages from ABC Plumbing. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.”
Consumers are required to opt in via verbal confirmation method when they press a keypad option during the call before any SMS texts are sent.
If the contractor misses the call, the call may be forwarded to the CallGuard system which automatically sends a single SMS response acknowledging the missed call and offering assistance on behalf of the contractor.
CallGuard facilitates conversational SMS messaging on behalf of service businesses.
Program Name: CallGuard Conversational Messaging
Purpose: To provide missed call notifications, callback coordination, appointment scheduling, and service-related updates.
Message Frequency: Message frequency varies based on user interaction.
Message & Data Rates: Message and data rates may apply depending on the consumer’s mobile carrier plan.
Opt-Out: Consumers may reply STOP at any time to unsubscribe from SMS communications.
Help: Consumers may reply HELP for assistance or contact [email protected].
CallGuard does not send marketing or promotional SMS messages.
